“The late Arthur Genshaft’s family and business, Superior’s Brand Meats, gave the Massillon Industrial Development Foundation $100,000 in 1982 to buy the land and then transfer it to the city to be used as a park”.
I guess I was under the impression that the Genshaft’s donated that particular piece of land. They just gave the city the money to buy the land.
So what the big deal if the city uses other land they bought and puts the Genshaft Park there. It’s not like the Genshaft’s were married to that particular piece of property.
Elum is just playing politics and I am quickly losing respect for the man.

Why would Elum start trouble for no good reason? Playing politics? Maybe you're right, but why?
Genshaft park has always been there. It's a nice location really, but if the family is OK with it I think a better location would be up new-241 where the other ballfields are. If anything so people knew they existed. May well increase the traffic and use of the current ballfields we have.
although I abhor the thought of another giant store in massillon, I think it's fighting an uphill battle. How much in taxes are we going to earn off Kohl's? What about employment opportunities. The name Genshaft will be on the other park, the same operations (right?), seems to be in the spirit of the gift

Neil Genshaft is alive and well running his family business. He is a true gentleman who really does not want this publicity. The only thing he wanted was re-assured there would be a replacement field.
On the other, hand His Honor Judge Elum is not as honorable as he would like us to believe. He and his buddy Johnnie Maier (aka George Lopez ) are the KINGS of game playing! They have tried to prevent progress more than once.
Elum stated he likes Frank, I believe it cause I read it in the INDY !
Thats why he gave the info to the paper, in hopes he could kill Kohls.
He is a judge, why is he giving legal opinions ? And poorly may I say.
Once again you don't have to be smart to be a Judge. If he was so smart he would be making a killing in private practice.

Folks, this isn't what I'm getting from reading the articles.
First of all, the Genshaft family wants to make sure that they have a solid guarentee that the the money will immediately be used to duplicate the fields at another location. I don't blame them, based on the way this administration, city executives and city council play shell games with money.
But, the second part is a contention about how the profits will be spent.
The land has appreciated to the tune of over $3 million. There are those that want to see the profits applied to pay down the Legends debt. There is another camp that wants to see all the profits also applied to new ball fields.
Personally, I haven't decided how I feel about the second point.
I HATE the location of Community Park. It's ugly and out in the middle of EBF. $3 million could be used to buy some primo land more where people live. Hell, why not use it to buy some of the Legends land from ourselves and locate the new ballfields there?
But, on the other hand, insisting that we spend the whole $3 million on new ballfields is a bit ludicrous.
Perhaps what Elum et al are really wanting to see is a compromise, using $1 million for great new ballfields, $1 million for other desparately needed park repairs and improvements, and the rest could go to Legends debt.

I thought I read somewhere that the administration promised that nothing would be done to Genshaft fields until the new fields at Community Park where up and running....Now I'm hearing that Kohl's will/may be breaking ground by this fall, yet nothing has even been started at Community Park as far as I know.......Looks like Massillon's Softballers are in for a screwing...:wtf:

My point number one exactly, Woody.
Past experience with these people has shown that you had better get a legal, binding requirement, or they may renege.
Does anyone remember the tree beautification program that we were all promised?
Separate funding came into the P&R department, and they promised to use it to cut down trees on the devilstrips for the homeowners that couldn't afford it.
I have personally sent three emails to the directors, past and present, asking about the status of the program and they have not given me the courtesy of a reply.

What in the heck are you talking about, DTN? Community Park, is like what, 10 minutes away from anywhere on the other(N.E.) end of town. And I don't know if you've noticed lately, but there are plenty of people who live out there now, aka the housing allotments near and right behind the park! And ugly? What is so beautiful about being sandwiched in between a highway, shopping complex, and an industrial area as Genshaft is now?:wall:
It seems to me that Kohl's is a much better fit in that area now than a baseball field. And the park a better fit for more baseball fields.

I respect everyones opinion on this one, I'm not a ball player so I could care less where the fields are.
The point is Kohls is BIG folks, really, really big. Good for Massillon! So in my way of thinking all elected officials should be on the same page on this. Not officeholders working to undermine a huge project like Kohls.
Elum needs to judge.........thats what he ran for..........that what he should do !

I can agree, I could care less were any ballfields are moved to etc. It just seems like you all thing Kohl's is the best thing since sliced bread with comments like Kohl's is good for Massillon...
It's just retail folks, no real $$ to be made by any of its employees. We lose Hoover & add a Kohl's? Just does not seem to make since.
Plus who ever builds the building will ether be a company out of state or at least a company in Cleveland.

I'm wondering about the attorney who is said to have penned the letter supporting the Genshafts. Mr. Elum indicated that attorney, a David L. Frankel, is "out of town and unavailable for comment." Yet, there is no "David Frankel" or "David L. Frankel" licensed to practice law in Ohio, according to the Ohio Supreme Court, which grants legal licenses in the state. Curious, isn't it?:scratchchin:

I had an opportunity to speak with Kenn Kaminiski about this issue and to see the actual plans for the new ballfields. I can honestly say that they are beautiful and will be a very nice tribute to the Ganshaft family. The Community Park location is a natural place for these fields. And it is only a short distance away from where they are now.
Not only will this be a plus for the ball players in the area, but it will also benefit our WHS cross country teams. It is the intention of those involved with the track team and cross county to develop a beautiful cross country course within the context of the park and this is to be done in conjunctioin with the construction of the new fields. We are embarrased when we hold cross country meets in Massillon (on those rare occasions when we do) because our course is at the Middle School and very poor--and dangerous to the runners.
So this developmpent has more than one positive element to it. I also think it is poor that all the fuss is being made now when the first announcement was made over a year ago.

Thanks, Mr. Deedee, good info. Besides, Mr. Genshaft already stated that he didn't care if the city moved the park somewhere else.
I've been wondering about something and I have a question. If the city sells this land for $3M, of which they only paid $100,000 for, won't they have a huge capital gain and resulting in a huge tax obligation? Do municipalities pay taxes on gains of real property?
So this developmpent has more than one positive element to it. I also think it is poor that all the fuss is being made now when the first announcement was made over a year ago.

I always thought that government agencies, public schools, etc. are exempt from federal, state and local taxes on their income.

Your correct, Al. I wasn't sure, but when I did a little research I found out that cities are exempt from taxes.
