The owner of a potato chip company says he won’t wait for an annexation appeal to be resolved, but will seek out other locations to expand operations.

“I’m running a potato chip business, not a political campaign for annexation,” CEO Bob Shearer of Shearer’s Foods said today.

Perry Township officials are challenging last week’s annexation of the 79-acre former Fleming Foods plant into Massillon. An appeal was filed Friday.

Stark County commissioners approved Massillon’s petition for the property, so Shearer’s Foods could expand its operations.

About 700 jobs are affected by the plans.

Shearer said he is “not completely abandoning” the Fleming Foods plant. However, he said he will not sit back and wait for a resolution.

“It’s disappointing. But we have a lot of people who want us,” he said.

Massillon Mayor Francis H. Cicchinelli said Shearer has been “upfront” from the start, telling township and city officials he has other locations.

“It’s no secret,” Cicchinelli said. “We’re trying to settle this thing with Perry Township. Hopefully, its not all lost and we can save jobs.”

Massillon’s petition did not include an agreement to share taxes, so Perry Township could lose all taxes on the property after 12 years. The lack of an agreement is the subject of Perry Township’s appeal.

Township Law Director Charles Hall and Trustee Craig Chessler could not be reached for comment.

Once again the powers-to-be in Perry dont care that many of Shearer's employees actually live and pay real estate taxes in Perry.:wall:

I would love to see Shearer's here, but if it dont work out perhaps the old Hoover Plant would make a nice home? I still hope Massillon can land it , but im not holding my breath either.

I was at City Council meeting last night, and Chici said they pretty much have an agreement worked out with Perry on the tax sharing issues. Looks like the deal will get done.

Someone should go over basic arithmetic with the Perry Township Wizards.

The Mayor offered 100% of property taxes forever. The trustees said No and
proceeded to beat the Mayor down to the point that they will now receive 80% for 6 years, another 60% for the next 6 years, then nothing for the next umpteen years.

How come I never get to negotiate with people that dumb?

Let's hope Shearers is still interested. Lubbock, Texas may offer them a
fabulous deal they can't pass up. Let's hope and pray they stay!

I think there's a very good chance that Shearer's prefers to move and they're looking for a scapegoat/excuse so they don't look like the bad guy. Either that or they're just playing for some more favorable incentives to stay.

You may be on to something, based on the tone of Mr. Shearer's recent comments and quick surrender.

Wow, I thought Michigan was bad, Ohio government is really screwed up. Why in the heck is a township governement involved in this in the first place. The purpose of a township goverment is solely to elect "trustees" to oversee land until it can be developed. Township trustees are not suppose to develop land, the land is either to be incorporated or annexed into an adjacent corporation.
If you want to know what is wrong with Massillon and Canton, it is those township governments that surround them. In any other state in the union, Massillon and Canton would be two to three times there size. Could you imagine the state and federal tax money Massillon would get if the population included the areas of Jackson and Perry. Massillon would be over 100K in population. You would still have your individual local school districts (school districts are different than political districts), but all within the same corporation limits.
I would not blame Shears for not staying. Why should they pay township taxes for an area that is now within a corporation. That is called taxation without representation.
